Gaukroger Nissan Privacy Policy
Gaukroger Sales Pty Ltd ABN 20 001 601 565 (we, us, our and other similar expressions) recognises the importance of your privacy. We understand your concerns about the security of personal information and are committed to protecting the personal information that we hold about you. We encourage you to read this policy carefully so that you understand how we deal with that information.
We operate several businesses, including Gaukroger Nissan, Inverell Off Road and Outdoor, Gaukroger Isuzu UTE, Inverell Hyundai, Inverell Mazda and F Gaukroger & Sons. This privacy policy applies to how we collect, use, disclose and store personal information for all the businesses we manage.
Personal information is information that is about you as an identified or identifiable individual. We collect most personal information directly from you. For example, you provide us with your information, including your name, address and telephone number, when you purchase a car or deal with us over the telephone or in person.
Our Privacy Principles
We are bound by the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth). Information we collect
In order to provide you with our products and services, we may collect and use personal information about you. We only collect and hold information about you that is necessary for us to perform the services or provide the goods you request from us. If we are not provided with all the personal information we request, we may not be able to supply our products and services to you, and you or your organisation may not be able to participate in future offers of goods or services which we supply.
The types of personal information we collect about you may include your name, address, email address, DOB, gender, driver’s licence number, age, sex, occupation, medicare card details, customer number with Road and Maritime Services and telephone number.
If you need finance for the purchase of a motor vehicle or other products we supply, e may also collect financial information on behalf of the financial institution that you ask to provide that finance, such as details about your assets, liabilities, income and expenditure, and other personal information, about you. We usually don’t retain a copy of that information after it has been passed on to the financial institution.
We do not normally collect or store ‘sensitive information’, as defined in the Privacy Act 1988 (Cth) (eg information about ethnic origin, religious beliefs or health). However, where we are required to and able to do so, we will ask for your consent before collecting your sensitive information and let you know the purpose at the same time.
How we collect personal information
Generally, we collect your personal information from you. For example, we may collect information from you when you complete our questionnaire, or when you provide us with information, whether in person, by telephone, online or in writing. If you submit an order (including by telephone or online), we will collect information necessary to fulfil that order.
How we store personal information
We take all reasonable steps to keep secure any personal information which we hold about you and to protect your personal information from loss, misuse or unauthorised alteration. We seek to protect your personal information from misuse, loss and unauthorized access, modification and disclosure by ensuring that your personal information can only be accessed by authorised persons.

- tell you about other products and services that may be of interest to you;
- learn more about your expectations of us and how we can meet them;
- disclose it to manufacturers for purposes such as managing safety issues and warranty claims, roadside assistance registration and co-ordinating marketing by manufacturers and/or its dealers;
- disclose it to motor vehicle financing companies, where you apply for or otherwise seek finance in connection with a motor vehicle;
- disclose it to insurers to assist with any motor vehicle-related insurances;
- disclose it to government authorities where disclosure is required for vehicle registration, inspection, approval or compliance purposes;
- disclose it to third party service providers and consultants, where disclosure is necessary to design, assess, certify or customise a vehicle at your request;
- communicate with you;
- inform you of any initiatives we think may be of interest to you;
- provide our products and services or other benefits to you;
- carry out our management, administrative, quality assurance and complaint handling activities in a professional and efficient manner;
- seek your opinion or comments about our products and services;
- carry out billing and debt recovery activities;
- develop and implement initiatives to improve our products and services;
- contact you to enable us to manage your account and fulfil our obligations to you or your organisation;
- recover monies owing to us from time to time;
- assist our related companies and other service providers (such as information technology providers and mailing houses), so that they can provide the services that we have contracted out to them; and
otherwise as required or permitted by relevant laws and regulations and for other secondary purposes.
We may require your consent to use and/or disclose your personal information if we need to use your information for a purpose that is not related to the purpose for which we collected it.
Marketing
We may use personal information to advise you of new products and marketing initiatives that we think may be of interest to you. This may include product or service offerings, newsletters and general information about us.
If you prefer not to receive information about our products and services, you can ask to be removed from the relevant circulation list by contacting us at the contact details listed below.
We never disclose personal information to a third party for the purpose of allowing them to direct market their products or services to you, unless you have expressly consented to that disclosure.
Access
You can gain access to personal information that we hold about you, subject to some exceptions under privacy legislation, and update your personal information if you believe it is inaccurate, incomplete or out-of-date. If you believe that your privacy has been compromised, you are entitled to complain.
However, where:
- the access impacts on the privacy of others;
- the request for access is frivolous or vexatious;
- there are existing or anticipated legal proceedings; or
- the access can be denied under law or by a law enforcement agency,
we may deny your request for access.

We may also charge a fee to cover the reasonable costs we incur in processing your request.
Quality and correction
We always try to make sure that the information we hold about you is accurate, complete and up-to-date. If at any time you believe the personal information that we hold about you is incomplete or inaccurate, please let us know. We will use all reasonable efforts to correct the information.
Changes to this policy
As our business evolves, our business processes and policies will be reviewed and may be amended. We may change this policy at any time. We will notify you of any change by posting an updated version of the policy on our website. We are committed to constantly improving our procedures so that your personal information is treated appropriately. Our privacy officer will:
- listen to your concerns and grievances;
- discuss with you the ways in which we can remedy the situation; and
- put in place an action plan to resolve your complaint and improve our information handling procedures if appropriate.
No disclosure to overseas recipients
We are not likely to disclose personal information to overseas recipients.
